Gardens of Southgate HOA

Geoffrey Westmoreland, attorney for the Gardens of Southgate Association, Inc. sent us this press release dealing with the controversy over the sign that the Burrs have in their yard.  Mr. Westmoreland says that since it is in litigation, he nor his clients can discuss it beyond this statement.

  1. I still don't think they should have to take it down, the Burrs son is fighting for the freedom that Westmoreland and all of his workers, not to mention the menacing losers who complain, still have... How much more unAmerican and ridiculous can someone be?

  2. "How much more unAmerican and ridiculous can someone be?"

    Are you issuing a challenge?

  3. To me that is the weasel's way out. Their attorney writing that letter just shows their disdain for the residents of the home. It's not the messenger, it's the horse he road in on. It's just an insult to the parents of an American serviceman...

  5. I think it should be taken down. They live in an HOA governed neighborhood - and i imagine all other signs will come down now as well.

  6. This entire matter is indicative of that wacko that is president of the Republican Women. Power hungry!!!

  7. A good soldier follows the rules. He would never have put up the sign, and he would take it down when advised it was against the rules of the community. He would not cry about it and ask for special treatment. These folks should be good soldiers.

    ReplyDelete
  8. Thank God the Burrs aren't soldiers!

A soldier follows orders because he is in a chain of command and that's what he signed up for.

A civilian can disagree the rules and enjoys the opportunity to try and change the laws which encroach on their freedoms.

The HOA may not even have the legal ability to prohibit such signs.

Finally, if we all just did what we were told an never questioned authority, then we'd all be perfectly content to shut up and follow our leaders over the cliff. Is that really what you want?

  9. I'm certainly not an expert in HOA law, or any other kind of law, but after some research, it seems Louisiana Revised Statute, Title 9, Section 1141.3 states:

"C. This Part shall not impair any right that is guaranteed or protected by the constitution of this state or the United States, nor shall this Part be construed to affect any act done, offense or violation committed, or right accrued."

A good sheeple does what the government tells him to do. A good sheeple will drive what the government tells him to drive. A good sheeple will give away his rights freely, when the government takes them.
    I hate sheeple.

  11. There have been and are Parkway High School signs, election signs, alarm company signs, etc. all around. By allowing these it seems they have set a precedent of not enforcing the HOA rules. They can't selectively pick and choose can they?.

    ReplyDelete
  12. This is a prime example of politicians trying to get there name in the paper for an upcoming election year. I doubt very seriously T. K. Mastny has ever served anyone but herself and does not have a fraction of a idea what sacrifice means. This case is awful close to infringing on ones freedom of speech and I for one will do what ever it takes to support the Burrs in fighting Mastny, Westmoreland, or anyone else that challenges the freedoms that I and so many others have fought to protect. So for the ones here that say the Burr's should follow the rules I say to you follow the US Constitution which gives us the right of freedom of speech.

    ReplyDelete
  13. The "unamerican" and "freedom" comments are getting ridiculous. Folks know the rules. When there are rules - there are rules. How often do you get upset when Prez Obama decides not to enforce things that should be?? I know I'm upset. Rules. are. rules. It doesn't make you unamerican.

    ReplyDelete
  14. Amazing, this Marine is in a fight to insure that morons that make up these HOA's are free to pursue their agendas. So sad that the real sacrifice of this war on terror is only being made by a very small percentage of Americans. Most Americans have no clue as to what is going on and could care less. They are more upset when American Idol is cancelled then when 8 soldiers die in a firefight. Once again, our military is at WAR, America is at the mall. Just so sad.

    ReplyDelete
  15. For those stating "the rules are the rules", the HOA knew the rules when they applied for non-profit status with the State. It seems the HOA is in violation of the state laws governing the HOA.

The Burrs are legitimately questioning the actions of the HOA.

  16. Who is the Developer of this neighborhood. They hold 3 votes to 1 on this. THAT is who everyone needs to bombard on this - they can't stand the bad press when it is already hard to sell a home.

    ReplyDelete
  17. Mastny, go away. I am sure you can find enough satisfaction in your SELF IMPORTANT club that you run.

    ReplyDelete
  18. Matt,
Why do you always go way off into left field with your arguments?

    ReplyDelete
  19. I have a solution. HOA want the sign taken down. The Burr's want the sign to remain. How about allowing them to display it on a temporary basis and both set a date that it should be removed.

    ReplyDelete
  20. Left field? Is that to say I'm a leftist or that I am extreme in my arguments?

"Extremism in the defense of liberty is no vice...Moderation in the pursuit of justice is no virtue."

Which promotes liberty, a resident enjoying the right to put a sign in his front yard, or being sued by a homeowners association to have said sign removed? One promotes liberty, the other destroys it.

    Which side are you on?

    ReplyDelete
  21. Matt,
Your last post proves my point. "in left field" is just an expression. It means you have gotten way off topic. But I'm sure you'll argue that with some more of your "fine" wisdom.

    ReplyDelete
  22. I understand that it is an expression, I was simply asking for clarification of your comment. I have been called a "leftist", I assume because I have attacked various Republicans.

I don't understand how I went off topic. If you do a search of the La Secy of State's office, you can search for "Gardens of Southgate" and only one organization is listed. It's a Shreveport address, so I'm not sure if it's the same one as the one in question.

If the entity is the same as the one listed in SOS, then they are in poor standing and are hypocritical for "the rules are the rules" stance. If it is a different entity, and the Bossier Gardens of Southgate is NOT registered with the Secretary of State, then do the laws apply to this entity?

    ReplyDelete
  23. As of Monday morning, Gardens of Southgate Association filed a report, bringing them "in good standing with SOS. Here's a report from last week with their status as "not in good standing".

  26. Hmmmm...the last I knew, this is still the United States of America, not a 'third world' country where everything is scrutinized. Furthermore, I guess the Constitution and the Bill of Rights got tossed away as well, so now we no longer have freedom of speech or expression, AND we have to put up with a 'committee' of bigots and snobs who want nothing more than to dictate and micro-manage how other people live their lives, I understand having 'neat and tidy' lawns, but come on where is the line drawn? What next~

If you are not willing abide by the First Ammendment to the Constitution, GET THE HELL OUT OF MY COUNTRY AND STOP INFECTING IT WITH YOUR GODLESS LACK OF COMPASSION FOR THOSE THAT ARE WILLING TO LAY THEIR LIVES DOWN TO PROTECT OUR FREEDOMS! There will come a day when you seek the protection and refuge of our God and Country and perhaps before your last dying breath as the munitions explode dangerously close you'll realize that you were the enemy all along. MAY GOD HAVE MERCY ON YOUR SOUL!

  29. HOA just remember if they cant have their sign then ALL signs need to come down. This includes the security signs, for sale/ garage sale signs, and ALL signs that support the local school teams. If the Burrs cannot support their son in the Marines then others cannot support their kids and school teams. HOA you might not want to open this box. Those that are actually complaining should be carful what they wish for. Signed a former Marine and father of two current Marines.

  32. This is an area heavily settled by military. I hope the subdivision reverses themselves quickly, as a military boycott of the subdivision will kill it.

I will turn any military families looking for homes away from this area.

If you did not catch it, this has made national headlines through the DrudgeReport.

  37. I can't believe that a family cannot take pride in the son military service. I have read the letter and find it to be a lawyer's way of duck and cover. This is why I do not belong to a HOA and never will.

    ReplyDelete
  38. The verbiage in this Press Release is just a smoke screen by the HOA to try and mimimize an embarrassing situation. The letter states that the issue is not the sign, but some other matter in which they cannot comment on pending litigation - probably means that the parents didn't ask the HOA permission to erect the sign. HOA's have some good points, but this lawsuit for removing the sign is a waste of money and the courts time!

    ReplyDelete
  39. First, HOAs have gotten far too powerful and petty in their sense of security. This should be yet another reason for people to contact their legislators to institute curbs on their abilities.

Secondly, the HOAs lawsuit strikes me as an overreaction based on the assumption that if you're right on the law, it's right to file suit. Filing a lawsuit is a dramatic escalation of a dispute, one that should only be taken when parties have already tried all the nonjudicial actions. This is much more of a financial burden to the Marine's parents, who likely don't have an attorney on retainer like the HOA. The HOA was evidently willing to "burn the bridge" with the parents, but I hope they're ready to reap their own whirwind of bad PR.

    ReplyDelete
  40. Total Bullshit and waste of time. Dispicable on all counts. I would like to see them take my sign down.

    ReplyDelete
  41. Why would anyone in their right mind buy a home that is subject to such nazi like HOA rules as is the case with Gardens of Southgate. Imagine the GALL of telling parents of a US Marine that they can not display a sign on their own front yard proclaiming that he is risking his life every day on the opposite side of the world in some God forsaken hell hole so that these (other types of holes) have the freedom to take away his parents freedom... How in the you know what do these out of touch with reality low lifes sleep at night??

    ReplyDelete
  42. What a bunch of tards, Im sure once their son returns from the war zone they will remove the sign, until such time leave it alone.

  43. This and many other occurrences are signs of our demise as America. Politically correctness and lack of common sense and decency will be our down fall. This is what we get when we put or allow people to rule over us that don't believe in the America that our founding fathers built.
Too bad that this Marine as well as this family is willing to fight for some citizens that would not hesitate to spit on their faces....

  44. Here is the Attorney who wrote the letter and is persecuting the Burr's. Politely let him know how you feel about the subject.

  45. For all you folks who do not live in Louisiana, Bossier City is in Bossier Parish. Take a look at any map and it will clearly identify that city and parish in NORTH Louisiana. Anything north of Alexandria is completely different in both culture and history than South Louisiana.

Now, my real reason for posting this comment: When are such organizations, associations, schools, etc. going to learn you can't fight the US Military and the people who support them. You only sully your reputation, making everyone in them appear unpatriotic.

I would also wager those fine people that I spoke of previously would be diligent in ascertaining the nazi's addresses and posting them in all their vehicles to make sure they stop and get donuts and coffee on their way to said nazi's residences.

  50. Just another example of why I would never live in a development with and HOA. The HOA boards are populated by losers whose only purpose in life is to make others march to their tune.

    ReplyDelete
  51. My son served 3 tours and lost good friends so people like you can do the BS you do. I put a large yellow ribbon around an Oak tree for each of my son's deployments and my neighborhood assc. never said a word. Shame on you!

    ReplyDelete
  52. I will never live in an HOA! I don't need a bunch of Morons telling me I can't support my son or our troops. Most people that are on a board like that are just there to say look at me I'm suppose to be important!

    ReplyDelete
  53. I just wanted to say, that this is pretty shameful on the part of"Gardens of Southgate HOA".let the Burrs have there constitution right Frist Amendment to support there son. "GOD BLESS THE BURRS".

    ReplyDelete
  54. All I can say is that I hope this HOA will get the short end of the stick in this case. What's next? HOA telling ppl how to decorate their house at Christmas or what window treatment to put up so the houses in the neighborhood don't clash?

    ReplyDelete
  55. It seems that disputes between HOA's and residents over patriotic symbols are popping up all over the place. I believe these HOA's have become entirely too dictatorial but to change them people need to participate and vote in reasonable boardmembers. As a former Marine I abhor what this HOA is doing and I hope they are publicly humiliated for their decision. I also think they are weasels for releasing that mealy-mouthed statement rather than finding an accomodation everyone can live with. I wish the son good luck and I know he comes from good stock.

    ReplyDelete
  56. SHAME SHAME SHAME We have a daughter in Iraq and we know how it feels to have our sons and daughter lay their lifes on the line for our country. 61. Let's let the fine folks of this HOA and their attorney's have a chance to support our military, as their letter states they do. I suggest a Static Line Jump from 12,500 ft. with full gear over Helmland Province. Upon meeting the Marine and thanking him for his service, provide the HOA personnel transportation to the nearest commercial airport and send them home with a greater understanding of the sacrifice's our military make on the behalf of the HOA personnel on a daily basis.

    ReplyDelete
  62. If it were not for young men like Mr Burr, you would not have your subdivision. Think this through and let common sense prevail over some silly covenant. America is watching your decision!

    ReplyDelete
  63. WTF. How about this? Burrs, get an even bigger sign and put it in your home's front window! Maybe a billboard too, just outside the entry to the subdivision!

Some of our fellow Americans have lost their minds. Maybe the Assoc. should move to another country. This is nuts.

    ReplyDelete
  64. Just another money grubbing lawyer and an elitist association dictating their personal issues onto others. So what some group of narrow minded morons created some "rules". There are more important issues in life and death other than a "No Sign" ordinance. Like maybe a community who shows some kindness for a hero?
When I was a young boy, my great uncle told me that the lowest form of human life is a lawyer, then a politician and followed by a banker. Guess nothing changes...

  69. This is why Home Owners Associations are bad. This isn't the decision of the neighbors, this doesn't represent their feelings. This is a work of a few scumbags who get off telling their neighbors how to live their lives. They answer to no one and their first instinct is to sue. If I lived there, I would use this as an excuse to demand an investigation of their books, and to find out how many kick backs their HOA board members are pocketing

    ReplyDelete
  70. The problem with folks in POWER, is they have NO common sense, and not a lick of patriotic blood in this group. 71. I am disappointed in some of the comments here. With that said that is what I fight for so most of you who have never served yet talk about being a soldier can say absolutely absurd and hurtful remarks towards myself and brothers in arms. I do not know what drives a person to decide a person should take down a poster of ones son or a soldier who is combat. If it where me I would not. God bless you all.

    ReplyDelete
  72. The HOA could have shown some leniency since their rules and laws are not constitutional. If they were patriotic, then it would also have been a good way to display it by allowing the banner. If not, well then....

I don't care if they are breaking a rule; others in your homeowner's association have signs in their yards. You have an un-American traitor within your organization who hides behind your lawyer. You've won the contempt of your country. Congratulations. You've earned it.

The Burrs have it right: it's not the message of the sign, it's the size. What a shame that the HOA and their puppet attorney are unable to step back and be patriots first, minor demagogues second.

    ReplyDelete
  76. As a nation we have lost our moral compass. Since when do folks that are safe at home with the safety provided by young men willing to lay down their lives, have a right to take a sign down. What harm does it do? If the association is so offended by the sign, bring the Marine home and the sign will come down. Better still how many of the offended neighbors are willing to trade places with the Marine.

Folks lets keep an eye on the ball!

    ReplyDelete
  77. Terrible. A man is risking his life fighting for the freedom of this country, the country that Mr Westmoreland lives in, and this is how he repays the family? This family spent their money to live in a neighbor that pays his sallery, and all he can do is worry about a sign showing support for their son! Ridiculous!! Guess he's never had family in the services. He must not know the since of pride that comes with one signing their life away for the freedom of this nation that he resides in! 81. Once again the left wing liberals are doing one thing and saying another. Boy, they are good at wool pulling. If the HOA board and other people of like thinking were subjects of an aggressive government or dictatorship such as what liberals seem to want us under, I dare say those folks and others like them would be begging to show support, in any form, for our military. I for one hope to find out where I can send support to the Burrs. Incidentally, who in that neighborhood checks on the board of directors to make sure they have each blade of grass growing the way the "leaders?" want the grass to grow. It makes me sick to think that my son who is a United States Marine is defending the freedom of these morons on this board. They should be ashamed of themselves. All 4 of my sons (Navy,Army,Marines) have served this country and continue to serve it. This association needs to take a long hard look at their rules and change them. I would never take the sign down no matter what they tried to do to me.

    ReplyDelete
  87. How about if we take all the idiots who are on the association board on a little trip to the middle east and drop them off and see just how our military would defend them and what our guys go through on a daily basis just to stay alive. 90. How Un-American can homeowners association be? This is a continuation of HOA suing against the American flag, patriotic signs and now the person fighting for their freedom to expose their lack of appropriateness and understanding.

    ReplyDelete
  91. Why don't they become a HOA in Afghanistan? Then they can decide if the homeowner gets dirt floors or grass mats.

    ReplyDelete
  92. I think the HOA should rethink their policy on the whole situation, the entirety of having the home owner's association to tell you what you can and connot display should not be allowed. For crying out loud it is Honor of their Son who proudly serves. I guess though that if any of the HOA's had a son or daughter serving over in Afghanistan, Kuwait or the Gulf it would be okay for them to display their support, but it is not alright for a Family that cares what their son is doing for this Country to support his actions and the actions of so many more that are fighting for our freedom and protection from the land of oppression. Where he is at I commend and thank Him for what he is doing. It is almost as bad as saying that you can't fly the American Flag and show support for our Country. The Sign Should Stay Up, It Needs To Stay Up. It is a Reminder to all of us as to why we are there in the first place. God Bless Him and I Pray for Him A Safe Return. God Bless the First Amendment Right, God Bless all those that Serve and all those that we Lost and most importantly of All God Bless America.

    Rules of the road:
    1. No personal attacks or insults.
    2. No accustory statements about wrongdoing or criminal acts against anyone.
    3. Say all you want about the pros and cons concerning the candidates and the issues, or the general subject of the blog post, just follow Rule #1 and Rule #2.

Why do these rules exists? Because a Marine is in heat that is far beyond your AC house, fighting for your right to challenge a sign. On 9/11/01 would this communist place to live had told people not to fly signs of union, compassion, or help. If you have rules to prevent Americans for celebrating their freedom and reasons for freedom then you need to get on a boat and go to a communist country that hates their country, then you might be happy. If any of you are military that supports this, talked face to face, or petitioned the removal than you are a disgrace to the uniform and country that you ONCE protected. When I went to Iraq in 2005, I lost more friends than probably live in that homeowners association, so quit up or move away for the USA.

  95. Get rid of the HOA they are all run by socialists today. They have lost their effectiveness since the commies got in and only want more money. They are thieves folks.

  96. As a decorated combat veteran of the USMC, I am as apalled with the unpatriotic actions of this HOA.

I applaud this Marine's parents and will support their legal expenses to the best of my means.

I want those parents to know how very proud I am of them.

Now, to whom do I send the Kool-Aid?

  98. I agree with the fact that HOA's nowadays are pieces of shit that don't serve a good purpose. They up the HOA on you for stupid shit and then you see their President, from one day to another, switch from a Toyota to a Lexus. Corrupt mother fuckers.

Now, not only are these HOA's a waste of money, they are also being inconsiderate. Let's use some common sense here. We live in America, where we live free because of our Armed Forces, and they want to start a fucking controversy over a medium size sign that displays a family's patriotism?

Good for that family for standing on their ground and using their freedoms as their son fights for it in an actual combat zone. I would say this falls under Freedom of Speech, if the Westboro Church can go to cities, showing signs that say "God Hates America", "Soldiers are fags", and in one of my buddies funeral "That Marine WAS A FAG", then the Burr's should most definetely be able to raise up that sign, and do it proudly!

Bottom Line: FUCK that HOA for being Un-Constitutional pieces of shit!

Oooooo and before I forget, some dumb ass posted

    "Anonymous said...
A good soldier follows the rules. He would never have put up the sign, and he would take it down when advised it was against the rules of the community. He would not cry about it and ask for special treatment. These folks should be good soldiers."

Listen "Anonymous", I want you to move to a country called CUBA, a place ruled by a tyrant, where if you don't follow those rules you get shot. Wait... I have an idea, why dont you and that HOA take you're opinions to CUBA?, live there together in happiness following bullshit rules/laws.

  99. This is shameful. Keep the sign up. Boycott buying a home in the Gardens of Southgate. Realtors do not show homes in this community.

    This is unamerican!

  100. This is ridiculous and those who say "rules are rules", there is a similar story of a war vet flying the AMERICAN flag in his yard for the 4th of July and the HOA suing him as well. Where does common sense come in? Where does American freedom come in? The day that I can no longer fly the American flag in my yard for fear of being sued by the HOA is the day I will stop wearing my military uniform. If I'm not fighting fighting for at least that freedom then what the hell are we fighting for? I fully support the Burr family.

  104. Who are the members of the board of the HOA? Lets find out and post there names here. The community has rights too. Like knowing who we are dealing with. Are some of these people in the military? Their CO might like to know about what they are doing. If they are civilians then their employers should be contacted and put on the web site. Fight back!!!

  105. I agree lets find out who the board is. Lets get with their employers and tell them what we think about having a un patriotic employee like members of the board.

  106. Just change the sign to read:
"While others build homes, Our Son, Cpl Corey Burr is building national security. We love him and support him to the fullest!" We now have a "building" sign which is permitted by the HOA. As for the attorney and members of the HOA, I have thrown the BS flag for their lame attempt to cover their collective butts. In the meantime, the negative press that this community is getting ensure the boards' place in history. Signed,

  108. I can personally attest to the voracity of homeowner's assocations. Those elected have no particular qualifications for the job, except that they have more time on their hands than the other residents. You can infer that to mean, they are bored, nosy, busybodies - or as we used to call them in our condo, "clones with clipboards". They are frustrated power hungry anal retentive individuals who are afraid of bullies but bully those they can get away with.

We once got a letter telling us that we were not cleaning up after our dog properly. Since we had a mini-dachshund and the offensive excrement was as big as he was, we thought they were joking. It reached the point where we forced them to convene the directors - we collected and laid out before them a series of offending poops - measured and weighed them. Then we brought in our dog, measured and weighed. Then we had our vet come in and explain that if a 7 pound dog passed a stool as large as those on the table, it would kill him. Even after that, it took them a week to come to a "ruling".

Sometimes, folks, people in authority have no business being there.

  109. This is great assignment of the house in the new development is almost always include the use of the property can be restricted.Typically, these restrictions are often called the Convention, conditions and restrictions put into the hands of the homeowners association decisions.
