Gardens of Southgate HOA

Geoffrey Westmoreland, attorney for the Gardens of Southgate Association, Inc. sent us this press release dealing with the controversy over the sign that the Burrs have in their yard.  Mr. Westmoreland says that since it is in litigation, he nor his clients can discuss it beyond this statement.

  7. A good soldier follows the rules. He would never have put up the sign, and he would take it down when advised it was against the rules of the community. He would not cry about it and ask for special treatment. These folks should be good soldiers.

    A soldier follows orders because he is in a chain of command and that's what he signed up for.

    A civilian can disagree the rules and enjoys the opportunity to try and change the laws which encroach on their freedoms.

    The HOA may not even have the legal ability to prohibit such signs.

    Finally, if we all just did what we were told an never questioned authority, then we'd all be perfectly content to shut up and follow our leaders over the cliff. Is that really what you want?

  9. I'm certainly not an expert in HOA law, or any other kind of law, but after some research, it seems Louisiana Revised Statute, Title 9, Section 1141.3 states:

    "C. This Part shall not impair any right that is guaranteed or protected by the constitution of this state or the United States, nor shall this Part be construed to affect any act done, offense or violation committed, or right accrued."

  11. There have been and are Parkway High School signs, election signs, alarm company signs, etc. all around. By allowing these it seems they have set a precedent of not enforcing the HOA rules. They can't selectively pick and choose can they?.

  12. This is a prime example of politicians trying to get there name in the paper for an upcoming election year. I doubt very seriously T. K. Mastny has ever served anyone but herself and does not have a fraction of a idea what sacrifice means. This case is awful close to infringing on ones freedom of speech and I for one will do what ever it takes to support the Burrs in fighting Mastny, Westmoreland, or anyone else that challenges the freedoms that I and so many others have fought to protect. So for the ones here that say the Burr's should follow the rules I say to you follow the US Constitution which gives us the right of freedom of speech.

So sad that the real sacrifice of this war on terror is only being made by a very small percentage of Americans. Most Americans have no clue as to what is going on and could care less. They are more upset when American Idol is cancelled then when 8 soldiers die in a firefight. Once again, our military is at WAR, America is at the mall. Just so sad.

  15. For those stating "the rules are the rules", the HOA knew the rules when they applied for non-profit status with the State. It seems the HOA is in violation of the state laws governing the HOA.

    The Burrs are legitimately questioning the actions of the HOA.

  22. I understand that it is an expression, I was simply asking for clarification of your comment. I have been called a "leftist", I assume because I have attacked various Republicans.

    I don't understand how I went off topic. If you do a search of the La Secy of State's office, you can search for "Gardens of Southgate" and only one organization is listed. It's a Shreveport address, so I'm not sure if it's the same one as the one in question.

    If the entity is the same as the one listed in SOS, then they are in poor standing and are hypocritical for "the rules are the rules" stance. If it is a different entity, and the Bossier Gardens of Southgate is NOT registered with the Secretary of State, then do the laws apply to this entity?

This includes the security signs, for sale/ garage sale signs, and ALL signs that support the local school teams. If the Burrs cannot support their son in the Marines then others cannot support their kids and school teams. HOA you might not want to open this box.   38. The verbiage in this Press Release is just a smoke screen by the HOA to try and mimimize an embarrassing situation. The letter states that the issue is not the sign, but some other matter in which they cannot comment on pending litigation - probably means that the parents didn't ask the HOA permission to erect the sign. HOA's have some good points, but this lawsuit for removing the sign is a waste of money and the courts time!

  39. First, HOAs have gotten far too powerful and petty in their sense of security. This should be yet another reason for people to contact their legislators to institute curbs on their abilities.

    Secondly, the HOAs lawsuit strikes me as an overreaction based on the assumption that if you're right on the law, it's right to file suit. Filing a lawsuit is a dramatic escalation of a dispute, one that should only be taken when parties have already tried all the nonjudicial actions. This is much more of a financial burden to the Marine's parents, who likely don't have an attorney on retainer like the HOA. The HOA was evidently willing to "burn the bridge" with the parents, but I hope they're ready to reap their own whirwind of bad PR.

Imagine the GALL of telling parents of a US Marine that they can not display a sign on their own front yard proclaiming that he is risking his life every day on the opposite side of the world in some God forsaken hell hole so that these (other types of holes) have the freedom to take away his parents freedom...   45. For all you folks who do not live in Louisiana, Bossier City is in Bossier Parish. Take a look at any map and it will clearly identify that city and parish in NORTH Louisiana. Anything north of Alexandria is completely different in both culture and history than South Louisiana.

    Now, my real reason for posting this comment: When are such organizations, associations, schools, etc. going to learn you can't fight the US Military and the people who support them. You only sully your reputation, making everyone in them appear unpatriotic.

  55. It seems that disputes between HOA's and residents over patriotic symbols are popping up all over the place. I believe these HOA's have become entirely too dictatorial but to change them people need to participate and vote in reasonable boardmembers. As a former Marine I abhor what this HOA is doing and I hope they are publicly humiliated for their decision. I also think they are weasels for releasing that mealy-mouthed statement rather than finding an accomodation everyone can live with. I wish the son good luck and I know he comes from good stock.

  61. Let's let the fine folks of this HOA and their attorney's have a chance to support our military, as their letter states they do. I suggest a Static Line Jump from 12,500 ft. with full gear over Helmland Province. Upon meeting the Marine and thanking him for his service, provide the HOA personnel transportation to the nearest commercial airport and send them home with a greater understanding of the sacrifice's our military make on the behalf of the HOA personnel on a daily basis.

What harm does it do? If the association is so offended by the sign, bring the Marine home and the sign will come down.   92. I think the HOA should rethink their policy on the whole situation, the entirety of having the home owner's association to tell you what you can and connot display should not be allowed. For crying out loud it is Honor of their Son who proudly serves. I guess though that if any of the HOA's had a son or daughter serving over in Afghanistan, Kuwait or the Gulf it would be okay for them to display their support, but it is not alright for a Family that cares what their son is doing for this Country to support his actions and the actions of so many more that are fighting for our freedom and protection from the land of oppression. Where he is at I commend and thank Him for what he is doing. It is almost as bad as saying that you can't fly the American Flag and show support for our Country.     3. Say all you want about the pros and cons concerning the candidates and the issues, or the general subject of the blog post, just follow Rule #1 and Rule #2.

    Why do these rules exists? Because a Marine is in heat that is far beyond your AC house, fighting for your right to challenge a sign. On 9/11/01 would this communist place to live had told people not to fly signs of union, compassion, or help. If you have rules to prevent Americans for celebrating their freedom and reasons for freedom then you need to get on a boat and go to a communist country that hates their country, then you might be happy. If any of you are military that supports this, talked face to face, or petitioned the removal than you are a disgrace to the uniform and country that you ONCE protected. When I went to Iraq in 2005, I lost more friends than probably live in that homeowners association, so quit up or move away for the USA.

    I applaud this Marine's parents and will support their legal expenses to the best of my means.

  98. I agree with the fact that HOA's nowadays are pieces of shit that don't serve a good purpose. They up the HOA on you for stupid shit and then you see their President, from one day to another, switch from a Toyota to a Lexus. Corrupt mother fuckers.

    Now, not only are these HOA's a waste of money, they are also being inconsiderate. Let's use some common sense here. We live in America, where we live free because of our Armed Forces, and they want to start a fucking controversy over a medium size sign that displays a family's patriotism?

    Good for that family for standing on their ground and using their freedoms as their son fights for it in an actual combat zone. I would say this falls under Freedom of Speech, if the Westboro Church can go to cities, showing signs that say "God Hates America", "Soldiers are fags", and in one of my buddies funeral "That Marine WAS A FAG", then the Burr's should most definetely be able to raise up that sign, and do it proudly!

    Bottom Line: FUCK that HOA for being Un-Constitutional pieces of shit!

Where does common sense come in? Where does American freedom come in? The day that I can no longer fly the American flag in my yard for fear of being sued by the HOA is the day I will stop wearing my military uniform. If I'm not fighting fighting for at least that freedom then what the hell are we fighting for? I fully support the Burr family.

  108. I can personally attest to the voracity of homeowner's assocations. Those elected have no particular qualifications for the job, except that they have more time on their hands than the other residents. You can infer that to mean, they are bored, nosy, busybodies - or as we used to call them in our condo, "clones with clipboards". They are frustrated power hungry anal retentive individuals who are afraid of bullies but bully those they can get away with.

    We once got a letter telling us that we were not cleaning up after our dog properly. Since we had a mini-dachshund and the offensive excrement was as big as he was, we thought they were joking. It reached the point where we forced them to convene the directors - we collected and laid out before them a series of offending poops - measured and weighed them. Then we brought in our dog, measured and weighed. Then we had our vet come in and explain that if a 7 pound dog passed a stool as large as those on the table, it would kill him. Even after that, it took them a week to come to a "ruling".

    Sometimes, folks, people in authority have no business being there.
