The Bossier/Webster Judge's race: an Update

Since the primary election on November 6th, the race for 26th JDC Judge has taken some twists and turns.
For anyone who is not aware of everything that has happened and is happening, this is an attempt to help you sort it out.
In case you have really been hiding under a rock, the candidates remaining are Michael Nerren. Nerren is an Assistant DA and has a private practice in Bossier City.
Whit Graves is a former State Trooper turned lawyer who served at one time as an Assistant DA, and is now in private practice.
Nerren has the endorsement of DA Schuyler Marvin, Mayor Lo Walker, Marshal Lynn Austin, and other public figures.
Graves has the endorsement of the Louisiana Republican Party.
Eleven years ago Whit Graves was sanctioned by the State Supreme Court for failing to file a sentencing memorandum in a timely manner. He received a nine-month suspension, deferred, and two years supervised probation.

Earlier this week, the Nerren campaign sent out a flyer stating that Graves had been suspended. In response, the Graves campaign released this letter from the State Supreme Court.
In the meantime, the Louisiana Republican Party endorsed Whit Graves for the position. The reason was a flyer that had been distributed by Julian Darby prior to the November 6th election. The Nerren campaign paid Darby $2,000, of which at least part was for the flyer.

The State Republican Party didn’t take kindly to issuing campaign material supporting Barack Obama for president, thus their endorsement of Graves.
The Bossier Parish Republican Executive Committee has a meeting scheduled for late next week, but I have no idea if this will be discussed.

  1. Jim please get your facts straight. Have you looked at the flyer yourself? The flyer clearly states as follows: "The Louisiana Supreme Court suspended White Graves from the practice of law in the State of Louisiana for nine months (deferred)..." The flyer clearly states that the suspension was deferred so please correct your column which states otherwise.

    The fact that he used these words is the part that makes this flyer incorrect. Graves didn't lie in court. It was a miscommunication. Also Nerren forgot to put deferred next to suspended. Please make sure to get your facts straight before trying to correct someone.

    On topic, I ask you to take a look at the two pictures. One says suspended in big red letters. The fact that it doesn't say deferred next to it is a lie from the Nerren camp.   11. Whit Graves privet practice specializing in DWI CASES, miscommunication (yea) lie. READ IT FOR YOURSELF!!!

    Respondent eventually filed a brief in this matter on October 18, 1999, but did not file a Sentence Review Memorandum. On November 29, 1999, this court personally informed respondent before beginning oral arguments in the matter that he was required to file a Sentence Review Memorandum. Respondent told this court he had a copy of the memorandum with him and would check with the clerk’s office after arguments to take care of the matter.

    After one month, respondent had still not filed a Sentence Review Memorandum. Accordingly, on December 28, 1999, this court ordered respondent to show cause why he should not be held in contempt for failing to file the Sentence Review Memorandum in a timely manner.

    Respondent appeared before this court on January 18, 2000, claiming that he had not received any notice that he was required to file a Sentence Review Memorandum, despite the order dated June 14, 1999 from this court and despite being personally informed by the court before oral arguments on November 29, 1999 of his obligations under Rule XXVIII. Respondent blamed his failure to file the Sentence Review Memorandum on his poor health, absences and incompetent staff. The Sentence Review Memorandum was finally filed in this court on January 18, 2000.

  14. A better course of action would be to acknowledge that Whit made a mistake and simply apologize for the mistake instead of foolishly minimizing what Whit actually did. The true character flaw of Whit and his supporters is the refusal to acknowledge the mistake instead of trying to put a spin on words. Man up and show responsibility and accountability instead of denying the truth.

  15. There is no attack and belittlement based upon who you are supporting. Just acknowledgement that your denial undermines any credible position you may have. Acknowledge the mistake and bad judgment concerning the Supreme Court case against Whit then maybe we can have an actual discussion concerning the election. Until then Mr. Z your position appears to be clouded by bias and uninformed decision making process.

  16. I have to chuckle when I read this...the video is discredited because it’s another bashing of Nerren? Hmmm let's see...what have ALL the others been...Bashing Graves on something that happened in 1999, apparently that is when Ms. Darlene worked for Graves because she takes it’s so personal. Obviously, she let the ball drop at some point or would not have such a personal vendetta on Graves. I would be more concerned with what is going on in the here and now. Ok, so Graves, messed up, obviously the Supreme Court forgave him, I have seen the letter of good standing and so has everyone else, so what’s the problem. He got his hand slapped. The way this Darlene carries on I would not be surprised if she ever told Graves about the calls, letters etc., who knows. From what I read on here, I would not be surprised at all if that ever came out. Which like I said, that was in 1999 or at least that is when she dated it. That was 13 years ago. The video from the above link is what is going on today. Who Nerren associates with, works for, the accusatory, below the belt flyer, payment to the UID, the sample ballot. Yet Nerren supporters want to say he is a man of integrity. I was raised birds of a feather flock together. People surround themselves with LIKE people.   23. Whit never said he would lower taxes. The flyer said he has a plan to not make your taxes go up by not adding another judge and support staff. Carlson tried to attack the flyer in her "opinion" article in the Bossier Press saying it would not "substantially" increase "local" taxes to add another judge because they are paid by the State. The letter to the editor the next week pointed out that State taxes were our money also. Everybody does know that Carlson is 1st Asst. DA Lane Pittard's personal secretary don't they?

  24. It has been my experience that less than 500 or so people are passionate about a local race. The rest just try to filter out the garbage to pick somebody. I just try to identify the most negative of the bunch and vote opposite.

  27. You can agree or disagree with Marty Carlson's conclusions, but she is one of the most informed people in the City/Parish. She attends meetings, talks to people, and often has more knowledge of what is going on than do a number of elected officials.

  28. The cognitive skill level on this blog is either very low or used to be one sided. At least as a Graves supporter, I see Nerren’s camp issue with the Supreme Court, got it. Yet once again, the Supreme Court, who has the right to judge, gave him his punishment. It is over, he messed up, and they punished, forgave and moved on. I have very low tolerance for people that take bits and pieces and run with it like it’s a winning lottery ticket. Did you read the flyer? It states he would streamline the court system. If the court system gets backed up another judge would be placed. With another judge come lots of courtroom expenses. These costs are paid for by us, the tax payers which in turn could mean raising taxes to cover it. So help me out, where is the LIE? Whit Graves for District Judge. Carlson is informed...like I have said birds of a feather flock together.

  29. Yal need to remember , those of you that say whit just 'made a mistake' when he got suspended need to know this: the Supreme Court does not sanction lawyers that 'make a mistake.' Lawyers are people and people do make mistakes. But whit graves was suspended for lying, not because he made a mistake. Lying is a flaw in a persons character and honesty

But in this case, you have been told in a million ways what happened...take a mixture of incompetent staff, work overload, and politics and you have your anwser, but you are not going to let this horse alone so I don't know why I even bother. It is just I am so sick and tired of all the hoopla over nothing..You best look at the video circulating. The information on the video does not surprise me; however, I do wonder how many other dots could be connected. Your candidate is a fine person. His achilles heel was not disassociating himself from the DA office prior to his decision to run for judge. He is a done goose.

  31. If you ask me if I will submit a report to you, and I do not, that is not a lie--it is more along the lines of exactly what the supreme court stated, he misled the court. Lying would be saying he submitted it when in fact he had not. (nerren and others love to double speak about what happened all the while claiming nerren is mr integrity. you cant have it both ways.

    Certainly it was a mistake in judgement on his part, 14 years ago. on the other hand we have a candidate that is being financed by a da's office under fbi investigation and other power players with a history of good ole boy sweetheart deals from that same office.

  37. If you read the decision, he was sanctioned for failing to follow an order of the court regarding a sentencing memorandum. No lawyer in their right mind would deliberately lie to the Supreme Court, and the opinion cited mitigating factors.
    The Nerren campaign seems to be very worried and obviously feels that unslung mud is the obstacle to election. Better be careful, that tactic has been known to backfire in the past.

  48. I think it is so sick to hurt all the familes and children in that video just to get votes. I do not feel a thank you is in order at all for I feel that who ever made that viedo and the supporters that keep posting it on facebook may one day be faced with a less fortunate situation and pray someone don't hurt them or their familes with their less fortunate situation. I support Nerren and know how Greaves will do anything even hurting familes and children and Lie to get what he wants.It was a horriable thing to do to drag supporters and their family through the mud just to get votes. Yes Graves has run before and everytime he has run this is what he does he Lies when the truth would serve him better. Turning this into the "poor families" routine insults our intelligence. The information is all in the public domain. It is also curious to me that the names I saw are some of his biggest supporters (nerren's)

    maybe someone should investigate some of those individual cases, and in the mean time figure out which ones the video producer did not find that I'm sure are out there.

And to sit and keep up the hateful bashing of both candidates and people supporting them says a lot about you people. Live and let live and mind your business. If people put this kind of effort into their own lives and families and focus on raising the children in this town with some morals and set better examples for the children then this would be a better world to live in.

I heard that channel 3 was going to run a story on the contents of the video and the odd coincidence that so many Nerren supporters had received unwavering prosecutorial discretion by the DA's office. They will also address the grim reality that many prosecutors determine who to prosecute merely on political considerations. This ought to be interesting!!!!

  68. I think it is pretty clear that Collier wants a new DA--these ads have nothing to do with a judge's race -or Mike Nerren that works in the Juvenile Division. Collier has a vendetta and has been attacking since he lost the Burchett Race. He and Adley together have done more to revive the good old boy system than Nerren could do in the rest of his life.

    Nerren is a baseball coach and a good man, these attack ads are not related to him.

    How many of Whit's cases have been nol prossed? Has anyone done a video on that?

    I respect both men, but do not like how this election has become more about replacing a DA than picking the best candidate for judge.

I think he is about making money, not caring about corruption, and the Inquisitor is just one of his tools to do so. Scandal sells, and he sells it. But as long as the authorities use his auction business, he seems to be happy with them.

  77. If you will Lie to the Supreme court you will Lie to anyone. I went to read the case and Graves did Lie. The fact is He Lied!!!!! MISLED is just a nice way of saying he Lied. I went through the case word for word and how the Grave supporters can say ohhh it was just a slap on his hand. yea do not think he got all that for telling the truth. Graves is dirty and has proven that to hold truth with all his Negative attacks. Let me give everyone a little run down Graves started first out the gate with a Lie about Nerrens wife and son,then Graves and his side kick Collier and Lawler started putting anything and everything about the DA'S office in the enquisder the one that Lawler owns every week to try and attack Nerren. Then Graves went and told a family member that he did not realize was family Mike Nerren worked for the Sheriff office and Marvin only hired him because he was broke. OH it gets better Graves then once again attacked one of Nerrens Family members his sister. Then from there a youtube viedo to attack Nerren's supporters and family then to send out a flyer and a commercial that Nerren voted for Obama and supported the Obama Health Care and paid for votes. Then to put out another youtube viedo called DEEP THROAT so I do believe that Graves has showed his true colors. Nerren's mail out and commercial state facts that has a case number to look up and read it all for yourself its facts and the fact is Graves has a history of Lying and vicousley attacking everyone to get what he wants. Do we want a Judge that will do whatever even Lie to win votes no matter the effect it may have on others.

  87. Nice try Darlene. If you look at the facts, the first attacks were from NERREN, everyone knows this except you apparently. Negative campaigning is part of politics, and it's normally done when you are behind, which I don't believe Nerren was, but nonetheless he initiated it.

    All these other accusations about Graves attacking Nerren's family is complete non-sense otherwise you would have "PROOF". You saying it's say doesn't make it so.

    Graves obviously did not produce the video, and I don't believe he even was aware of all the nol-prosse stuff that was exposed otherwise you would have seen it in traditional media (tv,radio) I wish Graves would expose to that media because people need to know about it.

    Who knows what is going on with the FBI investigation into Mike Nerren/Schuylar Marvin office, but nothing would surprise me at this point with that group.

  107. The problem with Darby is his reputation. Bossier Press wrote an article on him "dirty politics". Everyone knows this. On one hand people on this blog claim Nerren is this really nice guy with integrity, but his actions by utilizing Darby indicate something entirely different. i dont think mr ed can speak for graves, but from my viewpoint its the people he is associating with, as well as who he is being financed by (rich fat cats with various criminal charges mysteriously nol-prossed by his office)

  108. I love it when someone answers a question with asking another question. :) But to clear it up for you, here it goes. Yes, Julian is black and he's a democrat that pushed for the Obama vote. However, the color of Julian has got nothing to do with it. What is relevant however is that Nerren is running as a conservative republican and paid to have his name put on a sample ballot with a liberal democrat that collected a whopping 26 percent of the vote in Bossier Parish. A huge mistake on his part in my opinion when the overwhelming majority of the parish votes "R". Nerren's mailer is very weak. It's "misleading" at best, but we all have come to accept that in a political campaign haven't we??

  119. This election is embarrassing for Bossier/Webster, specifically the 26th JDC. I'm at the point where I feel bad for Cox, Self, Stinson, Craig and Robinson. Fact of the matter is, in my lifetime I have not seen a bad judge come out of Bossier or Webster, and this will not change after Dec 8th. Both are good men, good attorneys and good citizens that have contributed to this area and will continue to do the same regardless of the outcome.

  121. My wife and I early voted today. I know both candidates and like both of them. Either one would make a fine judge but we could only vote for one. What made up my mind was the state repubs endorsing Whit and I thought to myself, Self, are you tired of the complete stupidity that our state is going through and how everything is so messed up with the repubs running things. Self told me to vote against the one the state repubs endorsed and I would be voting for a very good man. Mike has at least 2 votes and I know he will be a very good judge. I am no party and sick of dems and repubs!

I understand from some at the court house the other judges do not like Mr. Graves at all. I understand he ran unsuccessful campaigns against both Robinson and Stinson and was on the campaign committee for Burchette against Craig. I would be interested to see what they have to say.   144. Please allow me to paint a portrait of the Graves campaign. I have been at most activities for months now which have included meetings, walking streets, attending football games, participating in parades, waving signs at busy street intersections. I have not heard one person...candidate nor supporters... say anything derogatory about the opponent. In fact at the onset I heard Whit's lovely wife Robin say that there was not going to be any negativity. If you had been present, you would have heard a lot of "uh and ahing" when a dog would peep through a window in a vehicle as he passed by, or you would have heard our cheers to the sound of horns, a thumbs-up jesture, or simple wave. You might also hear Robin yell, "Don't stand too near the curb!" You would also hear a lot of laughter and see embracing in hugs upon arriving and departing. What a great joy it has been to be a part of this exceptional group of folks. Thank you.

  191. A letter? Can we get a copy of the letter that was sent to the State Party from the PEC? How did they ask the State to withdraw the endorsement? Does the state have to comply? has this ever happened before? An endorsement not in writing to be withdrawn? Do they have to withdraw the verbal endorsement in writing or do they have to withdraw verbal endorsement verbally?
